A chain of bakeries specializing in cupcakes is alleging that a West Hollywood competitor infringed upon its trademark by ornating not only its packaging materials, but website and store with a “modern dot” trademark. Sprinkles, the name of the popular chain of bakeries with a location in Beverly Hills, is claiming that Famous Cupcakes infringed upon its trademark by utilzing its “modern dot” trademark to decorate pieces of merchandise as well as the the bakery’s store.

The owner of the alleged infringing entity, Desiree Adl believes the lawsuit brought against her company is frivolous, claiming that the whole situation is “silly.” Adl denies that any of her cupcakes contain the trademark “dot.” She ignored the letter sent to her from Sprinkles, citing that her cupcakes never contained the trademark and thus there was no need for worry. She started Famous Cupcakes nearly half a year ago.

This is not Sprinkles Cupcakes’ first time complaining of trademark infringement. Bakeries in various countires have recieved cease and desist notices from Sprinkles, all eventually acting accordingly. In the lawsuit, Sprinkles claims that the infringement has “damaged” their business and brought the “goodwill” of the “modern dot” design under question.
